What to Know About Road Rage in New Mexico

With traffic congestion and distracted drivers, driving can become, at times, extremely frustrating. Unfortunately, this sometimes leads to aggressive driving behaviors, which according to the AAA Foundation for Traffic Safety, are a factor in 54% of all fatal motor vehicle crashes

Road Rage Contributes to More than Half of All Fatal Car Crashes

Road rage is characterized by aggressive driving and factors into more than 50% of all fatal car crashes that end in death. It occurs when a driver drives aggressively and unsafely regarding others on the road. At times, road rage stems from only emotion and drivers intend on scaring or hurting other drivers.

Though there isn’t a specific law in Mexico for road rage, those who engage in such dangerous behaviors can still face consequences under other laws and charges, such as reckless driving.

What Does Road Rage Look Like?

Road rage can consist of a variety of actions, including the following:

  • Honking
  • Cursing/verbal insults
  • Physical threats
  • Obscene gestures
  • Speeding
  • Tailgating
  • Flashing your high beams
  • Ramming your vehicle into someone else’s vehicle
  • Sideswiping someone else’s vehicle
  • Driving another driver off of the road
  • Weaving
  • Throwing things
  • Running a red light
  • Cutting in front of another vehicle and then slamming on the brakes
  • Discharging a gun
  • Getting out of your vehicle to confront another driver
  • Intentionally changing lanes too close to another vehicle
  • Blocking cars trying to pass you or change lanes

What Are the Penalties?

When someone engages in road rage, they can face serious penalties. For instance, a first conviction for reckless driving is punishable by 5 days to 90 days imprisonment, or a fine of $25-$100, or both. A subsequent conviction may be punishable by 10 days to 6 months imprisonment and $50-$1000 in fines or both. An individual who has been convicted of a behavior encompassed by road rage may also face suspension of his or her driver’s license for a period of time. The exact consequences within the abovementioned ranges of punishment depend upon multiple factors, such as the intent of the driver and the outcome of his or her actions.
